1.Subject of the Contract

These general conditions concern the purchase of products or services, made remotely through a telematic network, from Calandra Arte di Sebastiano Calandra with registered office in Via Discovolo 295 – 19017 Manarola (SP). Every purchase transaction will be regulated by the provisions of Legislative Decree 6 September 2005, n. 206 (Consumer Code) and particularly those referred to in Section II, Part II, Title III (distance contracts) as well as, regarding the protection of personal data, by the provisions of Legislative Decree 30 June 2003, n. 196.

 

2. Purchase Order and Contract Finalization

The contract is finalized upon receipt by the Supplying Company of the purchase order for the selected products and/or services sent by the Customer on the website www.calandraarte.com. The submission of the electronic purchase order implies the Customer's full awareness and acceptance of these General Conditions and payment terms.

The Customer declares to have read all the information provided during the purchase procedure. If the Customer is a consumer (i.e., a natural person acting for purposes unrelated to entrepreneurial, commercial, craft, or professional activity), once the purchase procedure is completed, they shall print or save an electronic copy or in any case keep these terms of sale, also in compliance with the provisions of articles 52 and 53 of Legislative Decree 206/2005 regarding distance contracts. Any right of the Customer to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, deriving from the non-acceptance, even partial, of an order, is expressly excluded.

 

3.Purchase Methods

 Purchases of products and services sold on the website www.calandraarte.com are made at the price indicated therein, to be confirmed at the time of order confirmation, in addition to transport costs and the aforementioned taxes. Before confirming the purchase, the total cost of each product or service chosen, the total cost, including taxes, and the transport costs will still be summarized.

 

4. Prices and Payment

 Payment of the price of the purchased services and products and the costs of the relative transport must be made according to the method chosen during the ordering phase: CREDIT CARD - ADVANCE BANK TRANSFER.

 

5. Product Delivery and Shipping Costs

Product delivery will be carried out using the following methods, at the customer's choice:

  • Free collection by the customer at the Calandra Arte gallery in Via Discovolo 295 – 19017 Manarola (SP).
  • Express Courier. Delivery will be made to the address indicated by the Customer for shipping.

The customer is required to check that the package is intact, not damaged, or wet. Only after this check should the Customer accept the delivery. Once the delivery has been accepted, if the contents inside the package are damaged, the Customer will have 24 hours from the delivery date to contact Calandra Arte di Sebastiano Calandra and request an insurance refund, by sending photographs and/or videos in which the damage is clearly framed.

 

6. Order Processing Times

The processing days indicated in the product sheets are indicative, but in no case are considered mandatory. However, the Supplying Company will endeavor to process orders as quickly as possible, compatible with the production times for the products or the execution times for the services purchased. The Company will not be responsible for any delays by national couriers, attributable to external causes or force majeure. In this regard, the Customer declares to have been informed that the timing for processing an order varies depending on the type of work and the quantity requested. If the customer has purchased a service, they will be responsible for sending the necessary material to allow the Company to fulfill the service. The list of this material is specified in the service's product sheet. The Company cannot fulfill the service until the material is sent completely and exclusively in the manner illustrated in the service sheet.

 

7. Right of Withdrawal

The Customer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days, starting from the day of receipt of the products purchased on www.calandraarte.com. To exercise the right of withdrawal, the Customer must send an email to info@calandraarte.com and wait for the return form which will be sent to the Customer via email. Only when the customer has received the form can they ship the return. In no case will returns be accepted without the explicit request from the Customer and without the Company sending the return form. The Customer assumes the costs and risk of the return transport. Once the return has arrived at our warehouse in Via Discovolo 295 – 19017 Manarola (SP); the company will issue the refund within 14 working days. If the customer has purchased a service, they will not be able to exercise the right of withdrawal if they have sent incomplete required material.

 

8. Competent Court

For all disputes concerning the interpretation or execution of the contracts, the exclusive Competent Court will be the Court of La Spezia.
